New Round of Working Group “Concept Papers” Released: Comments Due March 31, 2023
The CT Department of Energy & Environmental Protection (DEEP) is continuing in its process of establishing a Release-Based Cleanup Program in Connecticut, to ultimately replace the Transfer Act.
DEEP is currently drafting the regulations for the new remediation program. This process has been informed by various “topical subcommittees” of the Working Group established to advise DEEP regarding the program’s development. The most recent “Third Phase” of topical subcommittees, made up of interested stakeholders, have released new “concept papers” for review and comment. The deadline to submit comments on these papers to DEEP by e-mail at DEEP.Cleanup.Transform@ct.gov is March 31, 2023.
The papers are available here, and evaluate (1) cumulative risk/risk-based alternative remediation approaches under the new program and (2) the potential role and qualifications of non-Licensed Environmental Professionals to investigate / remediate or handle other aspects of compliance under the new program.
